Strong arbitration practice
We have extensive experience representing clients on both domestic and international arbitrations. A number of our partners act as arbitrators of the Vietnam International Arbitration Center (VIAC) as well as publish and speak on arbitration topics. We act as counsel for parties in arbitrations conducted under the rules of all the major arbitration institutions and bodies, and we routinely handle international arbitrations involving a wide variety of subjects.
Our Vietnam Dispute Resolution Team is part of our broader global International Arbitration group, which comprises more than 200 lawyers who work in our offices in all of the major arbitration centres of the world.
Strong litigation practice
We have five professional litigators, including a senior litigator who has more than 20-year experience in taking and defending clients before local courts with extensive experience in corporate and commercial as well as tax and customs disputes.
Cross-border Dispute Resolution
We have significant experience managing cross-border disputes connected to Vietnam, including cases involving arbitration, litigation, and negotiations across different jurisdictions. We often deal with complex issues such as conflict of laws including supporting anti-suit injunction proceedings in other countries, recognition & enforcement of foreign arbitral and judgments in Vietnam, as well as investment & tax treaty claims.
With a strong understanding of Vietnam’s legal system and its interaction with international law, we are a trusted partner for multinational companies, investors, and local businesses in addressing the challenges of cross-border disputes.
Construction Disputes
Navigating construction disputes in Vietnam requires a nuanced understanding of the country’s evolving legal landscape and the specific challenges unique to the local construction industry. Our legal practice is deeply rooted in extensive experience with major international and local construction contract forms, including FIDIC, NEC, and bespoke agreements. We are well-versed in addressing common issues such as unclear regulatory frameworks, inconsistent enforcement, and cultural nuances that often arise in Vietnam. Over the years, we have earned the trust of leading construction companies by delivering strategic advice and effective dispute resolution, whether through arbitration, mediation, or court proceedings.
Banking & Financial Market Disputes
Our practice includes resolving wide spectrum of complex bank & financial market disputes from private lending and syndicated facility disputes to options and other derivatives disputes. We are experienced on loan defaults and asset financing issues, including aircraft and other high-value assets. With extensive experience navigating Vietnam’s regulatory landscape, we are adept at handling challenges like enforcing security interests and managing cross-border financing conflicts.
We provide pragmatic, results-oriented solutions through litigation, arbitration, or negotiation. Our tailored approach ensures clients receive the strategic support they need to protect their interests in Vietnam’s evolving financial sector.
Insurance Disputes
We have a strong track record of resolving insurance disputes in Vietnam, including life and non-life insurance products across health, property, and commercial insurance. Our team is experienced in tackling challenges like claim denials, policy interpretations, subrogation, and regulatory compliance in Vietnam’s rapidly evolving insurance market.
Managing risks before they emerge as disputes: Our team has extensive experience in assessing and managing legal and commercial risks during the drafting, negotiation, execution and performance of contracts, as well as other translation and legal incidents. Given that there are many grey areas in Vietnamese laws such as those concerning damage claims, best practice suggests that the parties, especially the offshore and foreign entities, invest sufficient time and efforts in the drafting, negotiation, and execution of contracts with local entities to increase the enforceability of the contracts.
